Houston lawyers Terry Bryant and Robert Kennedy along with eleven other lawyers, representing two estates and 37 individuals have sued Deep South and Lyondell & Houston Refining and sought to establish Jefferson County as the venue for the trials, by claiming that Deep South is a Jefferson County business, because its Texas office is located there.
Deep South, which is based in Baton Rouge, Louisiana maintains that its Jefferson County office is not a principal office and that any litigation should be heard in Houston, which is Harris County and the location of the accident.
Jefferson County District Judge Gary Sanderson has set a December 5th hearing on Deep South's motion to transfer the suits.
